Welcome to LiftWorks ("LiftWorks," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of liftsworks.com, including browsing compact tractors, mini excavators, tractor loaders, placing orders, and contacting support. By using our site, you agree to these Terms.

1. Use of Our Service

You may use our site only for lawful purposes and in accordance with these Terms. You agree not to:

• Copy, reproduce, or distribute content without permission

• Use automated tools (scrapers, bots) to access site data

• Attempt unauthorized access to our systems

• Post false reviews or interfere with other users

We reserve the right to suspend or terminate accounts for violations.

2. Products & Availability

• All equipment (John Deere tractors, Typhon excavators, loaders) sold factory-new from U.S. inventory

• Prices exclude tax, shipping, duties—final at checkout

• Stock shown as available; high-demand items may sell out

• Specifications based on manufacturer data—we're not liable for changes

• Images representative; actual equipment may vary slightly

3. Orders & Payment

• Orders binding once placed—review cart before checkout

• Payment via credit cards, PayPal Pay Later, ACH/wire

• Taxes calculated by shipping destination

• Prices may change without notice (current price applies at purchase)

• We reserve right to refuse/cancel orders (fraud, stock issues, errors)

4. Shipping & Delivery

Heavy equipment ships via freight carriers (flatbed/step-deck):

• 5-14 business days nationwide U.S.

• First 20 orders: Free freight (up to $500 value)

• Customer responsible for site access (forklift, permits)

• Inspect on delivery—note damage immediately

• Title transfers upon shipment; risk during transit with carrier

5. Pricing Errors & Cancellations

We correct pricing errors anytime. You agree to return overcharged items per Refund Policy. Pre-shipment cancellations: full refund. In-transit: treated as return.

6. Limited Warranty Disclaimer

Products covered by manufacturer warranties only (John Deere: 24 months/1,500 hours; Typhon: 2-4 years). LiftWorks provides no additional warranties—express or implied. Equipment sold "AS IS" except manufacturer coverage. Not liable for consequential damages.

7. Limitation of Liability

To maximum extent permitted by law:

• Total liability capped at purchase price

• No liability for indirect damages (lost profits, downtime)

• Heavy equipment involves risks—we provide specs, not engineering advice

• Site/service provided "AS IS" without uninterrupted guarantees

8. Returns & Refunds

Governed by our Refund & Return Policy. 30-day window for unopened equipment, 15% restocking + freight.

9. Intellectual Property

All content (photos, descriptions, logos) property of LiftWorks/manufacturers. Limited personal use license—no commercial reproduction.

10. Governing Law

Pennsylvania, USA law applies. Disputes resolved in Lehigh County courts. Heavy equipment sales involve interstate commerce—Federal Arbitration Act may apply.

11. Force Majeure

Not liable for delays due to weather, carrier issues, manufacturer stock, acts of God.

12. Changes to Terms

Updates posted here with "Last Updated" date. Continued use = acceptance.
